By accessing or using VideoTranscode's video processing API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
VideoTranscode provides a cloud-based video processing API that allows you to:
- Convert video files between different formats
- Transcode videos to various resolutions and quality levels
- Process videos using FFmpeg-based workflows
- Store processed videos temporarily on our cloud infrastructure
- Access videos through secure URLs during the retention period
3. Account Registration
To use our Service, you must:
- Be at least 18 years old
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be responsible for all activities under your account
4. Subscription Plans and Billing
4.1 Plans
We offer three subscription tiers:
- Free Plan: 10 jobs/month, 4-hour retention
- Pro Plan ($9.99/month): 100 jobs/month, 7-day retention
- Business Plan ($29.99/month): 1,000 jobs/month, 30-day retention
4.2 Payment Terms
- Subscriptions are billed monthly in advance
- Payments are processed through Paddle
- All fees are non-refundable except as required by law
- You authorize automatic recurring payments
- Price changes will be notified 30 days in advance
4.3 Usage Limits
Exceeding your plan's limits will result in service suspension until the next billing cycle or plan upgrade.
5. API Usage and Restrictions
5.1 Acceptable Use
You agree to use the API only for lawful purposes and in accordance with these Terms. You may not:
- Process illegal, harmful, or offensive content
- Violate any copyright, trademark, or other intellectual property rights
- Attempt to gain unauthorized access to our systems
- Interfere with or disrupt the Service
- Reverse engineer or attempt to extract source code
- Resell or redistribute the Service without permission
- Use the Service for cryptocurrency mining
- Exceed rate limits or abuse the API
5.2 Rate Limiting
API requests are subject to rate limiting. Excessive requests may result in temporary or permanent suspension.
6. Content and Intellectual Property
6.1 Your Content
- You retain all rights to videos you process through our Service
- You grant us a limited license to process and temporarily store your content
- You are responsible for ensuring you have rights to process the content
- We are not responsible for the content you process
6.2 Our Property
The Service, including all software, APIs, and documentation, is owned by VideoTranscode and protected by intellectual property laws.
7. Data Processing and Privacy
Your use of our Service is also governed by our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.
7.1 Data Retention
- Processed videos are automatically deleted after the retention period
- You are responsible for downloading videos before deletion
- We are not responsible for data loss after the retention period
8. Service Level Agreement
8.1 Availability
We strive for 99.9% uptime for paid plans. This excludes scheduled maintenance and circumstances beyond our control.
8.2 Support
- Free Plan: Community support
- Pro Plan: Email support within 48 hours
- Business Plan: Priority support within 24 hours
9. Warranties and Disclaimers
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF RESULTS
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDEOTRANSCODE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Service interruptions or data loss
- Damages exceeding the amount paid in the last 12 months
11. Indemnification
You agree to indemnify and hold harmless VideoTranscode from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you process through the Service
12. Termination
12.1 By You
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
12.2 By Us
We may suspend or terminate your account for:
- Violation of these Terms
- Non-payment of fees
- Fraudulent or illegal activity
- Extended inactivity
12.3 Effect of Termination
Upon termination, your access to the Service will cease immediately, and all stored content will be deleted.
13. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be notified via email or through the Service at least 30 days before taking effect. Continued use after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
16. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and VideoTranscode regarding the use of the Service.
